You are a client, prospect or supplier of SYNERGIE EXECUTIVE, or an agent of a supervisory authority. 

SYNERGIE EXECUTIVE is committed to ensuring the transparent and honest use of data that may identify you directly or indirectly (hereinafter referred to as "Personal Data") when you browse its websites (including its mobile applications) or use its services.  

SYNERGIE EXECUTIVE is committed to implementing adequate security and confidentiality measures to protect your Personal Data. 

2. Purpose of this confidentiality and personal data protection charter 

This charter of confidentiality and protection of personal data (hereinafter, the "Charter") informs you about the processing of your Personal Data collected from you or via third parties. In the Charter, you will find information on : 

  • The way in which this Personal Data may be used or communicated; 

  • How you can control the use and disclosure of your Personal Data; 

  • The way in which your Personal Data is protected, in compliance with the provisions of Law No. 78-17 of 6 January 1978 on data processing, data files and individual liberties, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter "RGPD").  

Please note that the Charter may be updated at any time by SYNERGIE EXECUTIVE. The date of the most recent update will appear on this page. We therefore invite you to consult it regularly. 

The present Charter applies to all services offered by SYNERGIE EXECUTIVE, with the exception of services governed by a specific charter. 

For any service covered by a specific charter, the provisions of that charter will take precedence over this Charter. 

3. Identity of the party responsible for processing your Personal Data 

The party responsible for processing your Personal Data is SYNERGIE, a European company with capital of 121,810,000 euros, whose registered office is at 160 bis rue de Paris, 92100 Boulogne Billancourt, RCS Nanterre 329 925 010.  

4. Processing of your Personal Data 


4.1 If you are an individual  

4.1.1. When you are a candidate 
 

a. For what purposes do we process your data? 

SYNERGIE EXECUTIVE provides HR services at Top Management level. In order to carry out its assignments, SYNERGIE EXECUTIVE may contact you to offer you potential assignments. You may also be registered in our candidate database.  
 

b. What is the legal basis for the processing we carry out? 

This processing is based on our legitimate interest in being able to identify suitable profiles to meet our customers' needs and to offer you new opportunities for your career. 

c. What data do we process? 

The categories of data processed are, in whole or in part, the following: 

  • Identification data (e.g. surname, first name) ; 

  • Personal data (e.g. your contact details) ; 

  • Professional data (your employment status) ; 

  • Summary of our discussions ; 


d. How do we collect your data? 

Your data is collected directly from you following your meeting, exchanges with you or consultation of your professional networks (e.g. LinkedIn). 
 

e. With whom do we share your data?  

As part of the processing, your data may be communicated to SYNERGIE EXECUTIVE's clients. 
 

f. How long do we keep your data? 

As part of the promotion of our offers, your data will be kept for five years from the last contact. 

 

4.1.2. When you take part in one of our services 
 

a. For what purposes do we process your data? 

We may need to process your data as part of our headhunting, interim management, coaching or assessment assignments. 
 

b. What is the legal basis for the processing we carry out?  

The processing described is carried out under the terms of the contract signed with our customer.  
 

c. What data do we process?  

The categories of data processed are, in whole or in part, the following: 

  • Identification data (e.g. surname, first name) ; 

  • Personal data (e.g. contact details) ; 

  • Professional data (e.g. CV) ; 

  • Economic and financial information (e.g. bank details) ; 

  • Sensitive data (NIR). 
     

d. How do we collect your data? 

Your data is collected directly from you when you contact us. 
 

e. With whom do we share your data?  

As part of this processing, your data may be communicated to the following categories of recipients: 

  • SYNERGIE EXECUTIVE's subcontractors carrying out all or part of the processing operations described; 

  • Public bodies to which the regulations provide a right of access ; 

  • SYNERGIE Group entities for which your profile could be relevant. 
     

f. How long do we keep your data? 

Your data is kept for five years from the end of the service or from the expiry of the time limits for appeals. If an invoice is issued, it will be kept for ten years from the date of issue.  

 

4.2 If you are a professional 

 

4.2.1. When you are a customer or prospect 


a. For what purposes do we process your data? 

SYNERGIE EXECUTIVE provides HR services at Top Management level. In order to carry out its assignments, SYNERGIE EXECUTIVE may contact you to offer you our services. If SYNERGIE EXECUTIVE provides a service, we will use your data to ensure the execution and monitoring of the service and to meet the various tax and regulatory obligations. 

You may also be registered in our prospects and customers database.  

 

b. What is the legal basis for the processing we carry out?  

The treatments described are carried out under : 

  • Contractual measures relating to the conclusion and management of a contract for the provision of one of our services; 

  • Our legal and regulatory obligations (e.g. fight against fraud, accounting obligations); 

  • Our legitimate interest in offering you our HR services. 

 

c. What data do we process? 

The categories of data processed are, in whole or in part, the following: 

  • Identification data (e.g. surname, first name) ; 

  • Professional details (e.g. job title, professional e-mail address). 

 

d. How do we collect your data? 

Your data has been collected directly from you at the time of our exchanges. 
 

e. With whom do we share your data?  

As part of this processing, your data may be communicated to the following categories of recipients: 

  • SYNERGIE EXECUTIVE's subcontractors carrying out all or part of the processing operations described; 

  • Public bodies to which the regulations provide a right of access ; 

  • SYNERGIE Group entities have a right to know. 
     

f. How long do we keep your data? 

Your data will be kept for the following periods: 

  • If prospect: five years from the last contact; 

  • Contractual data is kept for ten years from the end of the service or from the expiry of the appeal period; 

  • Invoices are kept for ten years from the date of issue.  

 

4.2.2. If you are an official of a supervisory authority 


a. For what purposes do we process your data? 

As part of their duties, the supervisory authorities may instruct their agents to contact SYNERGIE EXECUTIVE, whether for an exchange, an investigation or to carry out a check. If you are one of these agents, your data may be processed within the framework of these controls and any follow-up given to these controls. 

 

b. What is the legal basis for the processing we carry out?  

The processing described is carried out in accordance with the legal and regulatory obligations imposed on SYNERGIE EXECUTIVE such as: the Data Protection Act, the RGPD, the Energy Code, the Labour Code, etc... 

 

c. What data do we process? 

The categories of data processed are, in whole or in part, the following: 

  • Identification data (e.g. surname, first name) ; 

  • Professional details (e.g. job title, professional e-mail address). 

 

d. How do we collect your data? 

Your data has been collected directly from you when you contact us, or indirectly, either through our advisers or through the staff of the relevant supervisory authority. 

e. With whom do we share your data?  

As part of this processing, your data may be communicated to the following categories of recipients: 

  • SYNERGIE EXECUTIVE's subcontractors carrying out all or part of the processing operations described; 

  • Some of our suppliers (e.g. external consultants) ; 

  • Public bodies to which the regulations provide a right of access ; 

  • SYNERGIE Group entities have a right to know. 

 

f. How long do we keep your data? 

Your data will be kept for five years from the end of the exchange with you.  

5. Transfer of your Personal Data

In the course of its activities, SYNERGIE EXECUTIVE may be required to transfer certain data securely to third parties, in particular Personal Data, in order to carry out tasks necessary for the management of your contract or the improvement of its tools. 

Any transfer of data by SYNERGIE EXECUTIVE to a third country outside the EEA is carried out in compliance with the applicable regulations and in such a way as to ensure adequate protection of your data. In the absence of an adequacy decision by the European Commission, transfers are carried out in accordance with Article 46 of the GDPR, in particular by means of standard contractual clauses. 

In the event of a transfer to the United States, SYNERGIE EXECUTIVE will ensure that its partner: 

  • has subscribed to the EU-US Data Privacy Framework, i.e. has agreed to self-certify with the US Department of Commerce; or 

  • Has signed the standard contractual clauses in accordance with the European Commission's model.  

Finally, SYNERGIE EXECUTIVE may also be legally required to disclose your Personal Data to the competent authorities. This is the case in the event of legal proceedings or an injunction from a public authority. 

6. Security of your Personal Data 

SYNERGIE EXECUTIVE undertakes to take all useful precautions, as well as all appropriate organisational and technical measures in order to guarantee a level of security appropriate to the risk, involving in particular the implementation of means intended to preserve the security, integrity and confidentiality of your Personal Data and, in particular, to prevent them from being altered, damaged or destroyed, or to prevent unauthorised third parties from having access to them. 

However, the security and confidentiality of Personal Data also depend on good practice on the part of each individual. This is why we invite you not to share your passwords with third parties, to systematically disconnect from your profile and your social account (particularly in the case of linked accounts) and to close your browser window at the end of your session, particularly if you access the Internet from a computer shared with other people. This will reduce the risk of other users accessing your Personal Data. 

In order to guarantee the security of your data, we invite you to avoid any distribution to third parties, including by publication on social networks, of any document issued by SYNERGIE EXECUTIVE containing your Personal Data (invoice, contract, etc.). 

7. Exercising your rights 


As a data subject, you have the following rights: 

  • Obtain a copy of your Personal Data as well as information on how the Personal Data is processed and its legal basis (right of access); 

  • Rectify inaccurate Personal Data (including the right to complete incomplete Personal Data);

  • Delete your Personal Data (right to be forgotten); 

  • Restrict the processing of your Personal Data when: 
    - Their accuracy is disputed; 
    - The processing is unlawful but you object to the deletion of your Personal Data; 
    - We no longer need your Personal Data but it is still necessary for the establishment, exercise or defence of legal claims; 

  • Request the portability of your Personal Data in a machine-readable format to a third party (or to you) if our processing is based on your consent or on the performance of a contract entered into with you; 

  • Give general or specific instructions on how your Personal Data will be processed and used after your death; 

  • To withdraw your consent to the processing of your Personal Data (if such processing is based on your consent) without affecting the lawfulness of the processing based on consent carried out prior to the withdrawal of consent; 

  • Oppose the processing of your Personal Data for canvassing purposes. We also remind you of the possibility of registering free of charge on the Bloctel telephone anti-solicitation list;  

  • Obtain or consult a copy of the appropriate measures taken to transfer your Personal Data to a third country or to an international organisation. 

These rights may be exercised at any time and free of charge either by using the dedicated form, or by sending a signed letter to SYNERGIE 160 bis rue de Paris, 92100 Boulogne Billancourt. 

In the case of a written request (other than a form), your request must include the following information: 

1) If you are a current or former customer:  

  • The precise reason for the request ; 

  • Your full name(s); 

  • Your contact at SYNERGIE EXECUTIVE. 

2) If you are a prospect 

  • The precise reason for the request ; 

  • Your first and last name ; 

  • If you have been contacted by our services: the telephone number or e-mail address on which you were contacted; 

  • If you have contacted us: the telephone number or e-mail address you provided.   

3) If you are a supplier or agent of a supervisory authority 

  • The precise reason for the request ; 

  • Your full name(s) ; 

  • The circumstances in which we might have collected your data (e.g. contractual relations, audits, etc.) 

A copy of an identity document (e.g. ID card, passport) may also be requested if there is any doubt about your identity as an applicant. 

In the case of a paper request, you must also specify the address (email or postal) to which you wish to receive the reply. If you make a request via the form, a reply will be sent directly to the address you used to fill it in. 

The file relating to a request to exercise rights is kept for six months in an active database, then for five years in an intermediate archiving database as from the closure of the request to exercise rights. 

You also have the right to lodge a complaint with the local supervisory authority responsible for data protection: Commission Nationale de l'Informatique et des Libertés (CNIL), 3 Place de Fontenoy, TSA 80715, 75334 PARIS CEDEX 07. 

8. Cookies and trackers 

Cookies are text files stored and used to record personal and non-personal information about your browsing on Synergie websites. 

Synergie may use "cookies" or other technologies that may collect or store Personal Data in order to improve the services provided to you. The data that we may collect and process, depending on the type of cookies used, includes: 

  • Information about your browser; 

  • The URL of the page visited ; 

  • The origin of the visit (Internet, Comparator, etc.) ; 

  • The navigation route ; 

  • IP address. 

If you consent to the use of cookies on our sites, these cookies will be stored for 13 months on your terminal. 

You will be notified the first time you receive a cookie and you can decide whether or not to accept it. 9. Personal data of unemancipated minors

SYNERGIE EXECUTIVE's services are intended for an adult or emancipated clientele. Therefore, we do not intend to collect Personal Data from non-emancipated minors. 

Nevertheless, if it were to happen that, without our knowledge, such Personal Data had in fact been collected and processed without obtaining the authorisation of the holder of parental responsibility for the minor in question, we would then take all necessary steps to delete the said Personal Data as soon as possible. 

If you are the holder of parental authority in respect of an unemancipated minor and become aware that we have collected and processed data concerning him or her, you may contact us so that we may proceed with the deletion of said data by using the contact information indicated in Section 13 ("Contact") below. 

10. Changes to the charter 

We reserve the right, at our sole discretion, to amend the Charter at any time. 
These changes will come into force on publication of the new Charter.
